Welcome to Anvil & Garden. The terms "we," "us," and "our" refer to Anvil & Garden, a Texas-based business operating the website at www.anvilandgarden.com and the related online store, content, and services (collectively, the "Services"). The Services are hosted by Shopify Inc.
These Terms of Service ("Terms"), together with our Privacy Policy, Refund Policy, and Shipping Policy, govern your access to and use of the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Eligibility and your account
You must be at least the age of majority in your jurisdiction (typically 18 in the United States) to use the Services or make a purchase. By using the Services, you represent and warrant that you meet this requirement.
You may browse the Services without an account, but creating an account is required for certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We make every effort to display our products accurately. However, colors, finishes, and dimensions may appear differently on your screen due to monitor settings, photo lighting, and other factors. We do not warrant that the appearance or quality of any product will meet your expectations beyond what is described on the product page. We reserve the right to limit, discontinue, or modify any product without notice.
3. Orders and acceptance
When you place an order, you are making an offer to purchase. Your order is not accepted until we send you a confirmation email and your payment is successfully processed. We reserve the right to refuse, cancel, or limit any order at our discretion, including orders that appear to be placed by resellers, contain pricing errors, or that we are unable to fulfill.
You represent that the payment method you use is yours, you are authorized to use it, and the information you provide is accurate.
4. Prices and billing
Prices are listed in U.S. dollars unless otherwise indicated. We may change prices at any time without notice. The price charged for a product is the price in effect when your order is placed. Posted prices do not include taxes, shipping, handling, customs duties, or import fees, which will be added at checkout or invoiced separately where applicable.
We use third-party payment processors that handle credit card data securely under PCI-DSS standards. We do not store full payment card numbers.
5. Shipping and delivery
Shipping terms, processing times, and delivery estimates are described in our Shipping Policy. All delivery dates are estimates and not guarantees. Title and risk of loss pass to you upon delivery to the carrier.
6. Returns and refunds

7. Intellectual property
The Services, including all text, images, graphics, logos, product photography, and the design, selection, and arrangement of content, are owned by Anvil & Garden or licensed to us, and are protected by U.S. and international copyright, trademark, and other intellectual property laws.
You may use the Services for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, scrape, or create derivative works of any content on the Services without our prior written permission.
"Anvil & Garden" and our logos are trademarks of Anvil & Garden. Other product and service names mentioned on the Services may be trademarks of their respective owners.

- Infringe on intellectual property or other rights of any party
- Harass, abuse, defame, or threaten any other person

10. Relationship with Shopify
The Services are hosted by Shopify Inc. Any purchases you make are made directly with Anvil & Garden — not with Shopify. Shopify is not a party to any transaction between you and us. Information you submit through the Services may be transmitted to and processed by Shopify in accordance with the Shopify Consumer Privacy Policy.
11. Feedback
If you send us comments, suggestions, ideas, reviews, or other feedback ("Feedback"), you grant us a worldwide, perpetual, royalty-free license to use, modify, publish, and incorporate that Feedback for any purpose without any obligation to you.
12. Disclaimer of warranties
The Services and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected.
13. Limitation of liability
To the fullest extent permitted by law, in no event will Anvil & Garden, our officers, directors, employees, affiliates, agents, contractors, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Services or any products purchased through the Services — even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid us for the product or service giving rise to the claim, or one hundred U.S. dollars ($100), whichever is greater.
Some jurisdictions do not allow limitations on implied warranties or the exclusion of certain damages — in those jurisdictions, the limitations above apply only to the extent permitted by law.

You agree to indemnify, defend, and hold harmless Anvil & Garden, our affiliates, and our officers, directors, employees, agents, contractors, and licensors from any claim, demand, loss, or liability — including reasonable attorneys' fees — arising out of your use of the Services, your breach of these Terms, or your violation of any law or third-party right.

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, indemnification, and governing law) will survive.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of those courts.
17. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date at the top and, where appropriate, notify you through the Services. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.
18. Miscellaneous
- Entire agreement: These Terms, together with the policies referenced here, are the entire agreement between you and us regarding the Services.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
- No waiver: Our failure to enforce any right or provision is not a waiver of that right.
- Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Headings: Section headings are for convenience only and do not affect interpretation.
